摘 要:领域法学作为一种回应新兴学科的研究范式,崇尚“问题意识”“综合视角”“创新思维”的理念。以教育问题为导向的领域法学,应当成为教育法学的理论定位,这能够充分弥补传统部门法学体系封闭的局限,有效回应我国教育法治迅速发展的实践需求。教育法学的基本范畴是与教育现象相关的法律问题。今后的教育法学研究应当注重从价值体系、内容体系、方法体系三个方面协调推进,系统开展我国教育法学的体系建构。As a research paradigm in response to emerging disciplines,field law advocates the concepts of“issue consciousness”,“comprehensive perspective”and“innovative thinking”.The field law oriented by education issues should become the theoretical orientation of educational jurisprudence,which can fully make up for the limitations of the traditional departmental legal system and effectively respond to the practical needs of the rapid development of the rule of law in education in China.The basic category of educational jurisprudence is the legal issues related to educational phenomena.The future research of educational jurisprudence should focus on the coordinated promotion from three aspects:value system,content system,and method system,and systematically carry out the system construction of educational jurisprudence in China.
