摘 要:我国平台用工去实体化、去雇佣化、隐秘化及去劳动关系化等现状趋势,带来了平台劳动者权益保障缺失、利益群体分化、组织程度弱化、维权渠道不畅、矛盾风险突出等挑战,给劳动关系协调工作造成巨大压力。进入新发展阶段,亟须在现有探索的基础上,研究确立平台用工劳动关系的界定规则,推动建立适应平台用工的利益协调机制、诉求表达机制、矛盾调处机制和权益保障机制,构建平台用工和谐劳动关系,统筹劳动者权益保障和经济社会高质量发展。The current trends of de-entitlement,de-employment,secrecy and de-labor relations of platform workers in China have brought challenges such as lack of protection of rights and interests of platform workers,differentiation of interest groups,weakening of organization,poor channels for rights protection and prominent risks of conflicts,which have caused great pressure on the coordination of labor relations.Entering a new development stage,it is urgent to study and establish the rules for defining the labor relations of platform employees,promote the establishment of coordination mechanism of interests,appeal expression mechanism,conflict mediation mechanism and rights protection mechanism that adapt to platform employment.By building harmonious labor relations of platform employment,we will coordinate the protection of workers'rights and interests and high-quality economic and social development.
