摘  要:在劳动法中同工不同酬是难点。何为"同工",何谓"同酬",二者之间是什么关系,如何解释同工同酬,仍值得商榷。为了获得更多的启示,在比较法视野下以欧洲制度为出发点,对日本同工同酬制度对欧洲制度继受和超越进行了研究;同时,在论证日本同工同酬制度借鉴的可行性的前提下,以日本制度为借鉴对象,通过分析日本制度在同工同酬的解释论,"同工"和"同酬"的定义、范畴,同工同酬制度实操架构,"平衡待遇权"的导入等方面,可为我国同工同酬制度的重构提供一定的借鉴启示。In labor law, “unequal pay for equal work” is a difficult issue to present. What is “equal work”? What is “equal pay”? What is the relationship between the two? How can the concept of “equal pay for equal work” be interpreted? All these questions remain to be answered. To obtain more enlightenment, from the perspective of comparative law, starting from the European system, this paper studies the inheritance of Japan’s equal pay system and its surpassing of the European system. Meanwhile, on the premise of demonstrating the feasibility of the equal pay system in Japan, the Japanese pay system is used as reference in the interpretation of “equal pay for equal work” in Japanese pay system, definition and scope of “equal work” and “equal pay”, practice framework of “equal pay for equal work system”, and the introduction of “balanced treatment rights”. All these can provide some experience for the reconstruction of “equal pay for equal work” system in China.
