摘  要:电子诉讼应当同时具备可控复杂性和可行简单性的双重功能特性。增加电子诉讼可控复杂性的途径在于:在技术上,建立稳定、安全且功能多样的电子诉讼平台,并实现该平台与其他网络平台的互联互通;在法律制度上,确认异步审理的法律效力、建立相应的失权制度、确立电子签名的使用规则并扩大法院对涉网行政案件的受理范围。而要实现电子诉讼的可行简单性,则需要深入挖掘电子诉讼复杂性的来源,进而采取相应的应对举措:在技术方面,彰显电子诉讼平台的交互性;在制度方面,加强对电子诉讼的程序性法律控制;在机构方面,通过网络平台来实现对电子诉讼繁杂事务的有效治理;在人员方面,提升诉判主体各方运用互联网技术和法律规则的能力。Electronic litigation should have the dual functional characteristics of controllable complexity and feasible simplicity.In order to increase the controllable complexity of electronic litigation,in the technical aspects,we should establish a stable,secure and versatile electronic litigation platform,to realize the interconnection between the platform and other network platforms;and in the legal system aspects,we shall confirm the legal effect of asynchronous trial,establish the loss of rights system,construct the rules of electronic signature,and expand the court’s acceptance scope of network-related administrative cases.In order to realize the feasible simplicity of electronic litigation,we need to deeply tap the source of the complexity of electronic litigation,then take corresponding measures:in terms of technology,we should highlight the interactivity of e-litigation platform;in terms of system,we could strengthen the procedural legal control of electronic litigation;in terms of institution,we may effectively manage the complicated affairs of electronic litigation through the network platform;and in terms of personnel,we shall improve the litigation parties’ability of utilizing the internet and legal rules.
