摘 要:数字时代,教育环境中的数字化因素日益增多且相互融合的程度不断加深,推动了教育领域的深刻变化,引发了教育法治领域的重大变革。在教育高质量发展背景下,法治是教育治理的基本理念和基本方式,深化教育改革必然要求全面推进教育法治建设。在理论、技术、实践和制度四个层面相统一的逻辑基础上,探究教育法治应对数字变革的方向具有方法论意义。以“算法”为主导的教育法治建设在教育立法、教育执法、教育司法和法治教育等方面机遇与挑战并存,亟待通过数字增容教育立法、技术赋能教育执法、数据助力教育司法、智能加持法治教育,全面勾勒出蕴含“良法、善治、公正、素养”的数字时代教育法治的未来图景。In the digital age,the increasing number of digital factors in the education environment and the gradual deepening of mutual integration have deeply promoted profound changes in the field of education and triggered a major reform in the field of the rule of law in education.In the context of the development of high-quality education,the rule of law is the basic idea and basic method of education governance.Therefore,deepening education reform and development inevitably requires the comprehensive promotion of the construction of the rule of law in education.Currently,it is of methodological significance to explore the direction of the educational rule of law in response to digital transformation on the logical basis of the four levels of theory,technology,practice and institution.In the digital era dominated by"algorithm",the construction of education rule of law is still in a realistic situation of opportunities and challenges in education legislation,education law enforcement,education justice and rule of law education.It is urgent to outline the future picture of the educational rule of law in the digital era,which contains"good laws,good governance,justice and literacy",through initiatives such as digital-enhanced educational legislation,technology-enabled educational law enforcement,data-assisted educational justice and intelligence-supported rule of law education.
