公益性视角下高等医学院校临床教学基地建设的法治路径

摘　　要：临床教学基地是由高校与医院共建共享的人才培养平台,也是融通医疗、教育、科研三者的纽带。当前,临床教学基地建设制度规范存在着与上位法冲突、准入标准不系统、审核认定程序不严谨以及核心制度规范弱化等弊端。应当通过及时修订临床教学基地建设的行政法规范,发挥高校和医院章程在内部治理中的特殊作用,强化高校与医院的合同管理,切实保障临床教学基地建设的质量,以实现高等医学教育公益性的最大化。Clinical base is a talent training platform jointly built and shared by universities and hospitals and function as a link to bridging medical treatment,education and scientific research.At present,the legal institutions of clinical training have many disadvantages,such as conflict with the upper law,unsystematic admittance standard,deficiency of the examination and approval system,weakness in the core system and standard.In order to ensure the quality of clinical training base construction and maximize the public welfare of high medical education,legislative modification should be initiated soon.Government should excavate the special function that articles association of universities and hospitals.One of effective mechanisms is to strengthen the governance by contract between the universities and their counterparts may be a useful effective mechanism.
