摘 要:随着科技创新和社会发展,用人单位对商业秘密的维护意识不断增强,劳动者的自主择业机会增加,人才流动成为必然趋势.然而,关于竞业限制的劳动争议案件与日俱增.但《劳动合同法》及其相关解释中对竞业限制制度的规定不够详尽,以致司法实践中仍存在不少因主体、客体等要素应否纳入涵射范围而产生的争议.同时,缓解劳资矛盾,赋予劳动者更大的权利保障,成为促进社会平稳发展的必然之举,为此,建议在劳资关系中引入专项集体合同制度,完善竞业限制的违约机制,合理规定要素的适用范围。With the scientific and technological innovation and social development,employers’awareness of maintaining trade secrets has been constantly enhanced,and workers’independent employment opportunities have increased,and talent flow has become an inevitable trend.However,the number of labor dispute cases about non-competition is increasing day by day.However,the provisions of the labor Contract Law and its related interpretations on the competition restriction system are not detailed enough,so there are still a lot of disputes arising from whether the subject,object and other elements should be included in the scope of inclusion in judicial practice.At the same time,alleviating the conflict between labor and capital,giving workers greater protection of rights,has become an inevitable move to promote the steady development of society.Therefore,it is suggested to introduce special collective contract system in labor relations,improve the breach mechanism of competition restriction,and reasonably stipulate the scope of application of elements.
