摘  要:“孝”是人作为类存在的底线道德义务,本质在于对普遍性伦理生活的价值维护。从自然本能演化到人文智慧,“孝”从起初的“是”进展到人的有意识的“应当”,“孝道”成为人们遵循内心召唤的道德律令。“孝道”与“法治”在伦理意义上殊途同归,都是希冀人们过普遍性的伦理生活,二者从不同侧面合于伦理的普遍性。法治倡导伦理纲常,孝道出于人的良知,分属伦理问题与道德问题,必须通过教化中介使法治理性上升为伦理精神,促成二者的和解。The essence of“filial piety”,the bottom line moral obligation of human beings,lies in the value maintenance of universal ethical life.From natural instinct to humanistic wisdom,“filial piety”has developed from the initial“what it is”to the conscious“what it should be”,and it has become a moral law that that people follow in their heart.In the ethical sense,“filial piety”and“rule of law”share the same goal,hoping that people live a universal ethical life,and they are in line with the universality of ethics from different aspects.The rule of law advocates ethical principles,and filial piety comes from people’s conscience.They belong to ethical issues and moral issues respectively.We should upgrade the rule of law rationaity to ethical spirit through edification,and promote the reconciliation of the two issues.
