摘 要:个案全过程式诊所教育意图实现诊所法律教育的本土化。该模式以启发与讨论式教学为方法,以法律援助站为工作平台,以志愿者团体为教学基础。该模式虽然在提高学生法律实务能力和法律职业伦理素质、推进教学模式改革、促进社会管理法治化方面发挥了积极作用,但是也面临着学生志愿者专业知识储备不够、律师和法官等司法工作者参与度不高、学生志愿者代理资质不被认可以及案源不足的问题。继续优化该模式还需进一步探索“梯队式”队伍建设机制、学生志愿者身份认同机制、整合校外教学资源、设立校外法律援助咨询中心。The whole-process clinic education of individual cases aims to realize the localization of clinic legal education, which takes inspiration and discussion mode of teaching as the method, legal aid station as the working platform, and volunteer team as the teaching basis. Although this model has played an active role in improving students’ legal practice ability and legal professional ethics, propelling the reform of teaching mode, and promoting the rule of social management’s law, it also faces the problems of insufficient professional knowledge reserve of student volunteers, low participation of judicial workers such as lawyers and judges, unrecognized agency qualifications of student volunteers, and lack of case sources. In order to optimize this model, it is necessary to further explore the “echelon-style” team building mechanism, the identification mechanism of student volunteers, the integration of off-campus teaching resources, and the establishment of off-campus legal aid consultation centers.
