摘 要:专业实务能力是法律硕士培养的核心目标。法律职业市场中,法律硕士毕业生显现出“不知如何着手法律实务”“法律思维弱”“特定领域专业知识储备不足”等“不适症”。结合法律职业内在要求及市场需求,法律硕士应当具备极强的法律思维能力,娴熟的辩论、谈判、调解、表达、沟通交流能力,专业知识综合运用等多项能力。为实现专业实务能力培养目标,应当以“主动式教学”“法律思维为核心”“紧密结合专业实务”为基本理念,采取针对性的课程改革、提升专业实训、加强实务师资等措施。Cultivating the students'professional and practical legal capabilities is the core goal of the juris master education.In the legal profession market,graduates of the jurismaster show"unsuitable symptoms"such as"do not know how to proceed with legal practice","weak legal thinking",and"insufficient reserve of professional knowledge in specific fields".Combining the inherent requirements of the legal profession and market demands,the graduates should have the strong abilities of legal analysis and reasoning,the skills of debate,negotiation,mediation,expression and communication,and the capability to comprehensively apply the professional knowledge.In order to achieve the goal of training professional and practical capabilities,we should take"active teaching and learning","cultivation the legal thinking as the core",and"closely integrate professional practice"as the basic concepts,and adopt targeted curriculum reforms,improve professional training,and strengthen the qualified teaching provided by the teachers who are equipped with professional and practical skills.
