摘  要:民法典的颁布具有划时代意义,人格尊严和人格自由是民法典弘扬的精神,也应成为规范学校师生关系的依据。这既是依法治校的时代要求,也是师道尊严、特别权力理论在师生关系中“失语”与“不适”的现实选择。民法典时代师生关系的原则是以师生法律地位的平等为前提,以尊重学生自主意愿为重点,以双方权利义务的一致为目标。基于民法典的视域重塑师生关系需要各主体的努力,学校应建立平权式治理体系,教师应提升个人民法素养,学生应具有独立主体的意识和能力。The promulgation of the civil code has epoch-making significance. Human dignity and personal freedom are the spirit carried forward by the civil code, and should also become the basis for standardizing the relationship between teachers and students in schools. This is not only the requirement of the times to run the school according to law, but also the realistic choice of teachers’ dignity and special power theory in the relationship between teachers and students. The principle of teacher-student relationship in the era of civil code is based on the equality of legal status of teachers and students, focusing on respecting students’ independent will, and aiming at the consistency of rights and obligations of both parties. Reviewing the relationship between teachers and students from the perspective of civil code requires the efforts of all subjects. Schools should establish an equal rights governance system, teachers should improve their personal civil law literacy, and students should have the consciousness and ability of independent subjects.
