环境类多边条约中文译本翻译的方法论——以两项全球性国际水法公约为例

摘　　要：生态文明时代的国际法治需要以环境类多边条约为基础的国际法支撑。中国话语、中国方案和中国担当需要通过多边条约中文译本予以表达和贡献。基于跨学科属性,环境类多边条约英-中翻译在方法论上,于法学视角应该注重法律关系主体义务或责任的明确和准确表达,从翻译学视角需要运用静态对等策略,在自然科学方面应该关注专业术语的正确或合理表述。以1992年和1997年两项全球性国际水法公约为例,运用上述方法论分析中文译本存在的翻译问题,提出我国一方面需要着眼于长远和稳定建设强大而稳定的译员队伍体系,确保环境类国际条约中文译本特别是作准文本的质量,另一方面需要根据条约缔结程序的国际法对已有中文作准文本中的错误提出更正。The international rule of law in the era of ecological civilization needs to be supported by international law based on multilateral environmental treaties. Chinese words, Chinese proposals and Chinese commitments need to be expressed and contributed through Chinese texts of multilateral treaties. Based on the interdisciplinary attributes of English-Chinese translation of multilateral environmental treaties, the methodology of the translation should be, i)laying emphasis on clear and accurate expression of the obligations or responsibilities of the subjects of legal relations from the perspective of law, ii)applying the strategy of static equivalence from the perspective of translation, and, ii)paying attention to correct or reasonable expression of technical terms from the perspective of natural sciences. Taking the two global international water law conventions of 1992 and 1997 as examples, the above methodology is applied and defects of the Chinese texts of the two conventions are analyzed. For addressing the poor quality of Chinese texts of multilateral environmental treaties, proposals are made as that China should build a strong and stable team of translators to ensure the quality of Chinese texts of environmental treaties, especially the authentic texts, and to correct errors in existing Chinese authentic texts according to international law of treaty-making procedures.
