论在线诉讼中的程序转化——以《人民法院在线诉讼规则》第5条为视角

摘　　要：在法院适用在线诉讼过程中可能会出现案件不宜适用在线诉讼的情况,此时就涉及在线诉讼的程序转化问题。在线诉讼程序转化的理论基础主要在于程序匹配、权利保障和功能等值。在线诉讼程序转化主要包括实体性要件和程序性要件两个方面:前者主要是解决在线诉讼在何种条件下需要进行程序转化,后者主要是解决在线诉讼如何进行程序转化。按照不同标准可以对在线诉讼中的程序转化区分为不同类型,主要包括在线诉讼内部程序转化和外部程序转化、程序部分转化和程序整体转化。在线诉讼程序转化的法律效力存在肯定说和否定说两种观点,二者各有利弊。关于在线诉讼程序转化的法律效力,需要结合程序转化中所涉及的具体诉讼程序或诉讼行为类型来具体分析。When the court applies online litigation,there may be cases that are not suitable for online litigation.At this time,it involves the procedural transformation of online litigation.The theoretical basis of online litigation procedure transformation mainly lies in procedure matching,right protection and functional equivalence.Online litigation procedure transformation mainly includes two aspects:substantive elements and procedural elements:the former mainly solves the conditions under which online litigation needs procedural transformation,and the latter mainly solves how to carry out procedural transformation in online litigation.According to different standards,the procedure transformation in online litigation can be divided into different types,mainly including internal procedure transformation and external procedure transformation,partial procedure transformation and overall procedure transformation.There are two views on the legal effect of the transformation of online litigation procedure:the“positive theory”and the“negative theory”,both of which have their own advantages and disadvantages.The legal effect of online litigation procedure transformation needs to be analyzed in combination with the specific litigation procedures or litigation behavior types involved in the procedure transformation.
