摘 要:我国事业单位人事制度改革呈现出由“特殊权力关系”向“特殊劳动关系”转型的特征,但现行事业单位辞职制度未能匹配聘用关系的“特殊劳动关系”属性。存在聘用合同法律性质不明、相关制度衔接不畅、“但书”条款过于模糊等缺陷。为实现事业单位职工辞职权与事业单位公益性之间的合理平衡,现行立法应在坚持辞职保护为基础、意思自治为原则、公共利益为补充的基础上,明确聘用合同的法律性质、完善事业单位辞职具体规则、细化“但书”条款的内容。The reform of the personnel system of China’s public institutions shows the characteristics of transformation from"special power relations"to"special labor relations",but the current resignation system of public institutions fails to match the"special labor relations"attribute of employment relations.There are defects in this system such as the unclear legal nature of the employment contract,the poor connection between relevant systems,and the vague"proviso"clauses.In order to achieve a reasonable balance between the right of resignation and the public welfare of institutions,the current legislation should clarify the legal nature of employment contracts,improve the specific rules of resignation from public institutions,and refine the content of the"proviso"clauses with resignation protection as the basis,with autonomy of will as the principle and with public interest as the supplement.
