摘 要:教育惩戒是包括家庭教育惩戒、教师教育惩戒、学校教育惩戒和国家教育惩戒在内的完整惩戒构造体系。教育惩戒内含的管教性和约束性,体现了其本身的权力性特征。对教育惩戒权力性及其法理基础的探讨,有利于揭示教育惩戒权存在的正当性,也能够增进社会公众对教育惩戒活动的价值认同。这尤其体现在教师教育惩戒方面。对于教师教育惩戒权而言,学生的受教育权、教师的职业权以及日益权利义务化的师生关系都构成其法理基础。Educational punishment is a complete punishment structure system including family education punishment,teacher education punishment,school education punishment and national education punishment.The stewardship and restraint contained in education punishment reflect its own power characteristics.The discussion on the power of education punishment and its legal basis is helpful to reveal the legitimacy of the existence of education punishment power,and can also enhance the public's recognition of the value of education and punishment activities.This is especially reflected in teacher education punishment.For teacher education punishment rights,students'right to education,teachers'professional rights,and the increasingly rights-obligated teacher-student relationship all constitute its legal basis.
