摘　　要：司法建议在我国部分行政诉讼案件中呈现出功能扩张的趋势,协调和解型司法建议使司法建议从柔性的建议转变为实质性纠纷化解机制,有的司法建议已呈现出具有事实拘束力的特性。行政诉讼司法建议功能扩张是国家权力结构衍化的现实映射,也是司法实践理性的隐性考量,但功能扩张失当可能会导致当事人司法认知偏差与权利救济困难,也会引起行政权监督功能弱化和司法权威折损。故而,欲使司法建议制度在社会治理体系中真正发挥实效,应推动国家治理体系大格局下司法建议制度的转型升级,将司法建议制度融入诉源治理体系中,促进司法建议从权宜性治理转向制度化治理;同时厘清行政诉讼中司法建议的功能边界和适用的场域,并强化实践形态中行政诉讼司法建议的规范化运行。Judicial suggestion has shown a trend of function expansion in some administrative litigation cases in China.Coordinated and conciliatory judicial suggestion transforms judicial suggestion from a flexible suggestion function into a substantive dispute resolution mechanism.Some judicial suggestions have taken on the character of factual binding force.The expansion of judicial suggestion function in administrative litigation is a realistic reflection of the evolution of the state power structure.It is also an implicit consideration of the rationality of judicial practice.However,improper function expansion may lead to judicial cognition deviation of the parties and difficulty in remedying rights,weakening the supervision function of administrative power and degrading judicial authority.Therefore,in order to make the judicial suggestion system truly effective in the social governance system,the transformation and upgrading of the judicial suggestion system under the general pattern of the national governance system should be promoted.Integrate the judicial suggestion system into the litigation source governance system.Promote judicial suggestion from expedient to institutionalized governance.At the same time,clarify the functional boundaries and applicable fields of judicial suggestion in administrative litigation,and strengthen the standardized operation of judicial suggestion in administrative litigation in the form of practice.
