艺人经纪法律关系与艺人劳动法益保障  

On Artists’Legal Relationship with Talent Agencies and the Protection of Artists’Legal Interests of Labor

摘　　要：艺人经纪系以打造艺人产品为目的,通过为艺人开展指导、培训、包装、推广及为艺人寻找工作机会,并以此获取收益的活动。艺人经纪活动具有营利性、人力投资专用性,双方关系的专属性等不同于传统经纪的特征。艺人经纪可分为培养式艺人经纪、合作式艺人经纪两种类型。培养式签约艺人与艺人经纪公司法律关系具备人格从属性、经济从属性,符合劳动关系的本质特征。但其人格从属性、经济从属性在组织上呈现一系列变化,属于非标准劳动关系。为加强对艺人劳动法益的保护,需要构建艺人劳动法益保护制度体系;完善现行法律制度框架下演艺经纪纠纷的法律适用;强化艺人经纪管理机构的监管职责;建立艺人行业工会制度等。Talent agency aims to make profits by making artists popular and seeking opportunities for artists by providing guidance,training,package and promotion for them.The characteristics of talent agency activities are different from those of traditional agency activities,such as profit-making,human investment exclusiveness,and the exclusive relationship between the two sides.There are two types of talent agency relationships:cultivation and cooperation.For the artists who have cultivation relationship with talent agency,they bear a legal relationship with the characteristics of personality and economy subordination,which is in line with the nature of labor relation.But such kind of subordination presents a series of changes in organization,therefore,it belongs to non-standard labor relation.It is necessary to establish a system to strengthen the protection of artists’legal interests and to improve the legal application of talent agency disputes under the current legal systemframework.In addition,a labor union for artists shall be set up and the administrative supervision to talent agencies shall be strengthened.
