摘　　要：近年来,随着市场经济、物流行业的蓬勃发展,食品领域的串货行为发生率较以往有了大幅攀升,为监管部门提出了新的监管难题。本文结合一起涂抹酒水生产日期信息的行政处罚案例,对市场监管部门在执法实践中对串货行为的定性、查处以及涉及的食品标签违法行为的行政处罚法律适用进行分析,为破解串货行为监管困境以及规范串货行为行政处罚提出新的思路。In recent years,with the vigorous development of the market economy and the logistics industry,the occurrence rate of cross shipment in the food field has risen significantly compared with the past,posing new regulatory challenges for the regulatory authorities.Based on a case of administrative punishment for smearing the date information of liquor production,this paper analyzes the market supervision department’s application of laws on the characterization,investigation and punishment of the act of collusion in law enforcement practice,as well as the administrative punishment of the illegal acts involving food labeling,and puts forward new ideas for solving the regulatory difficulties of the act of collusion and standardizing the administrative punishment of the act of collusion.
