摘  要:在实施《中小学教育惩戒规则(试行)》背景下,建构中小学教育惩戒救助制度具有重要现实意义与适切性。建构中小学教育惩戒救助制度,有利于落实立德树人的根本任务、提高中小学教育治理能力、更好地保障中小学生的合法权益。中小学教育惩戒救助制度的建构需要遵循合法性原则、正当程序原则和可操作性原则。依据这些原则,建构以救助内容制度为前提制度,校内救助制度为核心制度,校外救助制度、司法诉讼救助制度和经济救助制度为重要补充制度的中小学教育惩戒救助制度体系。Under the background of the implementation of the Rules of Educational Discipline in Primary and Secondary Schools(Trial Implementation),it is of great practical significance and relevance to construct the assistance system of educational discipline in primary and secondary schools.The construction of assistance system of educational discipline in primary and secondary schools is conducive to implementing the fundamental task of strengthening moral education and cultivating people,improving the educational governance capacity of primary and secondary schools,and better protecting the legitimate rights and interests of primary and secondary school students.The construction of assistance system of educational discipline in primary and secondary schools needs to follow the principles of legality,due process and operability.Based on these principles,the assistance system of educational discipline in primary and secondary schools is constructed with the assistance content system as the premise system,the in-school assistance system as the core system,the off-school assistance system,the judicial litigation assistance system and the economic assistance system as important supplementary systems.
