摘 要:为满足管理与经营的需求,用人单位在用工管理的过程中往往伴随着大量的个人信息收集、处理,但在实践中,用人单位用工管理权、知情权的不当行使往往会与劳动者个人信息权益保障之间存在矛盾。而随着数字化时代的到来,劳动者个人信息权益被侵害的风险不断加大,给劳动者个人信息保护带来全新的挑战。在具有从属性的劳动关系领域,需要加强对劳动者个人信息的保护,解决由此引发的劳资冲突,以平衡劳资双方的利益。In order to meet the needs of management and operation,the employer is often accompanied by a large number of personal information collection and processing in the process of employment management.However,in practice,the improper exercise of the employer’ s employment management rights and the right to know often conflicts with the protection of workers’ personal information rights and interests.With the advent of the digital age,the risk of infringement of workers’ personal information rights and interests is increasing,which brings new challenges to the protection of workers’ personal information.In the field of subordinate labor relations,it is necessary to strengthen the protection of workers’ personal information and solve the resulting labor conflicts in order to balance the interests of both employers and employees.
