法教义学、社科法学与群众路线:法学方法论反思

摘　　要：社科法学与法教义学从分歧走向对话,首先需要反思各自的方法论性质。两者的方法论分歧源自解释传统的差异。在法律解释上,德国法教义学源自“释经传统”,美国社科法学则类似“律法传统”。不同解释传统背后的制约因素在于法民关系即解释主体结构的不同,这既是法教义学和社科法学的分歧成因,也决定着中国法律解释和法律实践的基本特点。因此,如果固守各自的立场和方法,社科法学与法教义学难以形成有效的对话和真正的互补。中国的社科法学和法教义学的实质对话和深层融合的基础,同样在于中国自有的法民关系。以群众路线统合法学方法,既需要法教义学也需要社科法学,需要调动一切可以调动的法律和社会资源。同理,这也要求法教义学和社科法学植根于中国特色社会主义法治道路的丰厚土壤,服从于“为人民服务”的根本宗旨。The dialogue and divergence between Law and Social Sciences and Legal Dogmatics call for a reflection on the nature of their respective methodologies.The methodological divergence stems from the differences in interpretative traditions.German Legal Dogmatics derives its legal interpretation from the interpretive tradition of believers interpreting the law.American Law and Social Sciences,on the other hand,resembles the legal tradition of holy philosophical legislation in its interpretation of law.The constraint behind the different interpretative traditions lies in the difference in the relationship between the law and the people,which is the structure of the interpretative subject.That difference is the cause of the divergence between Legal Dogmatics and Law and Social Sciences,and also determines the basic characteristics of Chinese legal interpretation and legal practice.Therefore,it is difficult to form an effective dialogue and true complementarity if we only start from our respective positions and approaches.The basis for a substantive dialogue and deeper integration of Law and Social Sciences and Legal Dogmatics also lies in China s own legal and civil relations,which should unify the jurisprudential approach with the mass line and lead to the further development of Chinese jurisprudence.Similary,Law and Social Sciences and Legal Dogmatics should be based on the rule of law in Socialism with Chinese characteristics and follow the principle of“serving the people”.
