新职业教育法实施背景下高职院校实习生的权益保护研究

摘　　要：高职院校实习生的权益保护工作事关人才培养质量和社会稳定。2022年全面修订的职业教育法在总结经验的基础上对实习设定了若干明确规则。新规则针对近年来的典型违规案例,坚持以人民为中心的理念,从实用角度出发,在搁置理论研究争议的基础上设置了若干监管底线。实习领域相关主体的基本权利义务清晰可见,将对下位法的制定起到积极的指引作用,实习生的权益保护可望迎来一个全新局面。对于新法中的援引性规定和留白技术处理,近期可考虑出台司法解释、颁布部门规章,远期可制定行政法规。The protection of the rights and interests of higher vocational college interns is related to the quality of talent training and social stability.The vocational education law comprehensively revised in 2022 sets a number of clear rules for practice on the basis of summing up past experience.On the basis of summing up past experience,the newly revised Vocational Education Law in 2022 sets a number of clear rules for practice.These new rules aim at the typical violations in recent years,adhere to the concept of people centered,and set a number of regulatory bottom lines on the basis of shelving theoretical research disputes from a practical perspective.The basic rights and obligations of relevant subjects in the field of internship are clearly visible,which will play a positive role in guiding the formulation of the subordinate law.The protection of the rights and interests of interns is expected to usher in a new situation.For the quoting provisions in the new law and the technical treatment of leaving blank,we can consider issuing judicial interpretations and departmental rules in the near future,and formulate administrative regulations in the long term.
