涉外律师研究生项目人才培养模式创新的思考

摘　　要：法律硕士(涉外律师)研究生培养项目是我国涉外法治人才培养模式创新的尝试,对于我国涉外法治建设有着极其重要的意义。本文结合教育部和司法部联合颁布的《法律硕士专业学位(涉外律师)研究生指导性培养方案》和培养单位的实施方案,分析了法律硕士(涉外律师)研究生人才培养理念和项目实施中标准化与特色化的关系、高校与联合培养单位的关系、法学教育与其他学科教育的关系、境内培养和境外培养的关系等需要关注的主要问题,并提出“订单式”培养、“学徒制”培养、海外培养等项目实施的具体建议。The LLM program of foreign⁃related lawyers is an innovative attempt of Chinese cultivation model of foreign⁃related rule⁃of⁃law talents,which is of great significance to the construction of the countrys foreign⁃related rule of law.This article combines the“Guiding Program for Cultivating Postgraduates of Professional Degree in Laws(Foreign⁃Related Lawyers)”jointly issued by the Ministry of Education and the Ministry of Justice and the implementation plan of the training units,and analyzes the talents cultivation concept and project implementation in the LLM programs of foreign⁃related lawyers the series of innate relationships,such as the relationship between standardization and specialization,the relationship between universities and joint training units,the relationship between legal education and other disciplinary education,the relationship between domestic training and overseas training.This paper also puts forward other major issues,specific suggestions and implementation measures that are needed attention,such as the“order⁃based”training,the“apprenticeship”cultivation,and overseas cultivation programs.
