摘　　要：在新科技革命浪潮下,法律应充分发挥其效能,积极应对挑战,在促进科技发展的同时防止科技异化给人类带来的灾难。文章从科技与法律的互动关系出发,分析了科技对法律的器物层、制度层和观念层3个层面的影响,以及法律对科技“兴利”“除弊”两个方面的作用。在此基础上,重点聚焦人工智能技术和生物技术领域,考察科技发展带来的法律挑战,并从科技法学科建设、科技法体系构建以及建立制度化的科技与法律沟通交流渠道等3个角度提出相应建议。Under the wave of new scientific and technological revolution,law should give full play to its effectiveness,actively respond to challenges,while promoting the development of science and technology to prevent the alienation of science and technology to human disaster.Starting from the interactive relationship between science and technology and law,the article analyzes the influence of science and technology on the three layers of law:the object layer,the system layer and the concept layer,as well as the law of science and technology,“Profit”and“Eliminate abuses”two aspects of the role.On this basis,the article focus on the field of artificial intelligence technology and biotechnology,examine the legal challenges brought about by the development of science and technology,and puts forward corresponding suggestions from three perspectives,namely the construction of science and technology law discipline,the construction of science and technology law system,and the establishment of institutionalized dialogue channels between science and law.
