摘  要:2022年“十四五”推进农业农村现代化规划指出,要积极盘活利用农村闲置宅基地和闲置住宅,为农村宅基地使用权的抵押指明了方向,全国多个试点地区进行了实践探索。目前我国宅基地使用权抵押存在着抵押主体范围小、申请抵押难度高、宅基地价值评估不到位、风险防范机制不完善等问题。应从完善相关法律、扩大抵押主体范围、放宽申请抵押的条件、完善宅基地价值评估标准及完善风险防范机制等五个方面来破解宅基地使用权抵押的困境,以提高农民抵押积极性,充分发挥宅基地的财产价值。The"Fourteenth Five Year Plan"to promote agricultural and rural modernization in 2022 pointed out that we should actively use idle rural homestead and idle housing,pointing out the direction for the mortgage of the right to use rural homestead,and many pilot areas throughout the country carried out practical exploration.At present,there are some problems in the mortgage of the right to use the homestead in China,such as the small scope of the mortgage subject,the high difficulty in applying for mortgage,the inadequate evaluation of the homestead value,and the imperfect risk prevention mechanism.The dilemma of mortgage of the right to use house site should be solved from five aspects:improving relevant laws,expanding the scope of mortgage subject,relaxing the conditions for applying for mortgage,improving the evaluation standard of house site value and improving the risk prevention mechanism,so as to improve the enthusiasm of farmers for mortgage and give full play to the property value of house site.
