摘 要:从《国际海上避碰规则》某些概念的含义出发,分析直航船在早期采取行动的权利和直航船行动规则的某些问题解说,指出其危害性,给出直航船行动要点解读.认为提倡“双让理念”海上避碰机制的时机已经成熟,研究了双让行为及具体做法,以及践行船舶双让理念的避碰机制,给出了让路船和直航船的紧迫局面距离和紧迫危险距离.确立海上船舶避碰实务以避免紧迫局面为核心举措和第一要务,明确“及早”行动也适用于直航船,只要第十七条1款(2)项中规定的情况出现,直航船就应该首先“独自采取操纵行动”.Based on the meaning of some concepts of the International Convention for Preventing Collisions at Sea,this paper analyzes the right of stand⁃on vessel to take action in the early stage and some explanations of the action by stand⁃on vessel are analyzed,their harms are pointed out,and an interpretation of the actions by stand⁃on vessel is given.It is believed that it is ready for the maritime collision avoidance mechanism that advocates the“concept of double vessels avoidance”.The behavior and specific methods of the concept of double vessels avoidance,as well as the mechanism of collision avoidance to practice the concept of double vessels avoidance,are studied.The close quarter situation distance and collision distance of the give⁃way vessel and the stand⁃on vessel are given.Establish collision avoidance practices for vessels at sea to avoid urgent situations as the key measures and the first priority,and clarify that“early”action also applies to the stand⁃on vessel.As long as the circumstances specified in paragraph(2)of Article 17-1 arise,the stand⁃on vessel should first“take action to avoid collision by her manoeuvre alone”.
