关于教育考试制度编入教育法典的若干思考

摘　　要：教育考试制度是国家教育制度的重要组成部分,当前该制度在治理层面存在法律规范体系不健全、价值理念单一、某些具体制度可能违背法律保留原则等问题。在教育法典编纂的背景下,需要对包括教育考试制度在内的教育法制进行体系化重构。在教育法典总则中,应通过提取教育考试的“公因式”,规定教育考试的原则性、通行性、一般性规范;在教育法典分则中,应根据不同教育考试类型规定相应的考试主体及其权利义务、考试实施流程、考试监督及争议解决机制。The education examination system is an important part of the national education system.At the governance level,the system faces some challenges,such as an incomplete and uncoordinated legal system,deviation of value objectives,and violation of the principle of legal reservation.Under the background of the compilation of the educational code,the educational examination system should be systematically reconstructed.Specifically,in the general provisions of the education code,the principle,universality,and general standards of the education examination should be stipulated by extracting the"common factors"of the education examination;while in the specific provisions of the code,the corresponding examination subjects and their rights and obligations,the examination implementation process,the supervision mechanism and the dispute resolution mechanism should be stipulated for different types of education examination.
