摘  要:学位制度是教育法典化中应该明确的重要法律制度。改革开放以来,中国的教育立法以1980年《学位条例》颁布为先导,经过四十余年的快速发展,促进了以《教育法》为基本法、覆盖多个教育阶段的法律法规组成的教育法律体系框架的形成,教育法典化条件已然具备,但还存在教育单行法之间逻辑不清晰、教育法典化的教育学原理不明确等问题。因此,教育法典化视域下的学位制度建构,应该与构建高质量教育发展体系和终身教育体系的教育学原理结合起来,除在教育法典的总则编中规定国家学位基本制度外,还应在高等教育编、职业教育和继续教育编等完善相应的学位制度。The degree system is an important legal system that should be clarified in the codification of education.Since the reform and opening up,China’s education legislation has been guided by the promulgation of the Regulations on Academic Degrees in 1980.After more than 40 years of rapid development,it has promoted the formation of the framework of the education legal system consisting of laws and regualtions covering multiple stages of education with the Education Law as the basic law.The conditions for the codification of education have already been met,but there are still problems such as unclear logic between the single laws of education and the indetermination of pedagogical principles of the codification of education.Therefore,the construction of the degree system from the perspective of education codification should be combined with the pedagogical principles of constructing high-quality education development system and lifelong education system.In addition to stipulating the basic system of national degree in the general provisions of the education code,the corresponding degree system should also be improved in the compilation of higher education,vocational education and continuing education.
