总体国家安全观视域下网络金融犯罪的综合治理

摘　　要：在总体国家安全观视域下,网络金融犯罪治理是防范化解重大金融风险、实现金融刑事法治现代化的重要组成部分。但是,我国现有网络金融犯罪的治理实践存在治理模式混乱化、治理方向单向度和封闭性、治理效果与治理目标之间弥散化等问题,一定程度阻碍了网络金融犯罪治理目标的实现。为了推动网络金融犯罪治理的效能取得“质”的突破,有必要以总体国家安全观为指导,从多元主体协同共治的理念出发,构建网络金融犯罪综合治理的范式,将网络金融犯罪的行政监管、刑法治理、被害预防、社会治理、效果评估等构成要素有机协调起来。由此,真正实现网络金融犯罪治理的生态化、系统化、多元化与现代化。From the perspective of the holistic view of national security,the governance of network financial crimes is an important part of preventing and defusing major financial risks and realizing the modernization of financial criminal rule of law.However,there are some problems in the current governance practice of cyber financial crimes,such as chaotic governance mode,one-way governance direction,closed governance,dispersion between governance effect and governance objectives,which hinder the realization of the governance objectives of cyber financial crimes to a certain extent.In order to make a“qualitative”breakthrough in the governance efficiency of cyber financial crimes,it is necessary to take the holistic view of national security as the guidance,start from the concept of multi-subject cooperation and co-governance,build a comprehensive governance paradigm of cyber financial crimes,and organically coordinate the components of administrative supervision,criminal law governance,victim prevention,social governance,effect evaluation and other elements of cyber financial crimes.Thus,the ecological,systematic,diversified and modern governance of network financial crimes can be realized.
