环境公益诉讼损害赔偿金存取方式的探讨与制度构建

摘　　要：大规模的环境侵害案件,大额赔偿金如何进行管理,是我国现阶段环境公益诉讼中面临的重要问题。规范层面有关赔偿金的存取方式没有规定。实践中现阶段存取赔偿金的方式存在信息公开不完善,资金去向不明确等问题,难以满足公众对环境后续修复的关注需求。为了实现环境公益诉讼的价值预期,立足于实践中探索出的经验,比较国外的方式,对环境公益诉讼赔偿金存取方式进行制度构建,构建出一种更具高效性、透明性、中立性的方式:以环保组织设立基金账户的方式来存取损害赔偿金,设立基金网站,公开赔偿金使用情况,采用政府与公众监督的模式来保证赔偿金的合理使用,满足公众需求,从而实现保护环境的目的。How to manage large-scale environmental infringement cases and large compensation is an important issue facing environmental public interest litigation in China at this stage.At the regulatory level,there is no provision on the method of deposit and withdrawal of compensation.In practice,the current methods of accessing compensation have problems such as imperfect information disclosure and unclear funding destinations,which are difficult to meet the public's demand for follow-up environmental restoration.In order to realize the value expectation of environmental public interest litigation,based on the experience explored in practice,compared with foreign methods,the system construction of the deposit and withdrawal method of environmental public interest litigation compensation is constructed,and a more efficient,transparent and neutral method is constructed:the method of establishing a fund account by environmental protection organizations to access and access the damages,set up a fund website,disclose the use of compensation,and adopt the mode of government and public supervision to ensure the reasonable use of compensation funds and meet the needs of the public,so as to achieve the purpose of protecting the environment.
