教师法修改应建立公职教师与教育行政机关的“公务派遣”制度

摘　　要：公职教师,即作为“国家公职人员”的教师,应限于义务教育阶段公办中小学在编教师。教育行政机关在公职教师的招聘、工资发放和解聘等事项上发挥关键性作用,所以应参考劳务派遣制度,建立教育行政机关和公职教师之间的“公务派遣”制度。基于“公务派遣”关系,教育行政机关应与公职教师签订聘用合同,公职教师应接受教育行政机关的公务派遣。《教师法》应将这种“公务派遣”关系法定化。Public teachers are teachers with the legal status of“employees of public institutions”.Public teachers should be limited to teachers,who are employed in public primary and secondary schools with officially budgeted posts during the compulsory education period.Since educational administrative agencies play a key role in the recruitment,payment and dismissal of public teachers,like the labor dispatch system,a system of“official dispatch”between educational administrative agencies and public teachers should be established.Based on the“official dispatch”relationship,the education administrations shall sign an employment contract with the public teacher,and the public teacher shall accept the official dispatch of the education administrations.The Teachers Law should legalize this“official dispatch”relationship.
