肉类注水犯罪行为的影响因素与因应建议

摘　　要：探究影响肉类注水犯罪行为的主客观因素和作用机理,为针对性防控肉类注水犯罪行为提供方向与理论基础。选取117篇法院判决书,应用扎根理论对案例进行探索性分析,揭示影响肉类注水犯罪行为实施的因素,构建其影响因素模型,并引入遏制理论对各影响因素进行分析。结果表明:行为人的意识观念与屠宰场的管理水平是肉类注水犯罪行为的内部因素,其可进一步分为内部推力因素与内部遏制因素;购销商扭曲偏好、购销商信息处理能力、行业环境、外部监管、支持条件属于外部环境因素,其可进一步分为外部拉力因素与外部遏制因素。基于扎根探索结果,结合遏制理论,从微观与宏观2个维度提出防控肉类注水犯罪行为的具体对策。To explore the subjective and objective factors affecting the illegal act of injecting water into meat and the mechanism of the targeted prevention and control of such crimes to provide direction and theoretical basis,about 117 court judgements in China Judgements are selected,and the grounded theory is applied to make exploratory analysis of the cases,revealing the factors influencing the implementation of the illegal act of injecting water into meat,constructing the influencing factor model,and introducing the containment theory to analyze the influencing factors.The results show that the consciousness of the perpetrator and the management level of slaughterhouse are the internal factors of meat water flooding crime,which can be further divided into internal thrust factors and internal containment factors.Buyers and sellers’distorted preference,buyers and sellers’information processing ability,industry environment,external supervision and support conditions are external environmental factors,which can be further divided into external pull factors and external containment factors.Based on the results of grounded exploration and combined with the containment theory,the specific countermeasures for prevention and control of the illegal act of injecting water into meat are proposed from micro and macro dimensions.
