职业院校混合所有制改革的制度评析与完善

摘　　要：为研究职业院校混合所有制改革的制度实施情况,探索现行相关制度体系的缺漏并为完善制度提出建议,以职教混改的制度文本为分析基础,以相关司法案例为实证对照进行研究,发现现行制度存在位阶较低、过于笼统、定义宽泛、管理模糊等问题,上述问题也在司法案例中得到印证。通过合理界定混合所有制办学的概念,明确不同模式办学的产权制度、管理机制、支持措施和法律责任,健全监管机制,提高立法质效等,有助于提升办学主体积极性和办学成功率。In order to study the reform implementation of the mixed ownership system of vocational colleges and universities,explore the shortcomings of the current relevant system and make suggestions for the improvement of the system,based on the text of the system reform of mixed vocational education,with reference to relevant judicial cases as an empirical comparison,this paper has found that there are some issues as lower ranking,generality,broad definition,and vague management,.which have also been confirmed in judicial cases.By rationally defining the concept of mixed ownership in running schools,clarifying the property rights system,management mechanism,supporting measures and legal responsibilities in different models of running schools,completing the supervision mechanism,and improving the quality and efficiency of legislation,it is expected to be beneficial to enhance the enthusiasm of the subjects of running schools and the success rate of running schools.
