摘 要:王阳明关于法的思想体系可以概括为几个方面:从法的来源看,阳明之法属于神意法和父权法的混合;在法的内涵上,阳明之法体现和维护的是等级秩序;在法的功能上,阳明强调法立事行、抑强扶弱;在执法上,阳明强调执法公正;关于法的局限,阳明指出,所托非人则法律废弛,法律严苛则适得其反,要情法结合。阳明之法体现了中国传统天人思想的特色,具有其优越性和局限性。Wang Yangming’s thoughts on law can be summarized in several aspects.In terms of the source,Yangming’s law is a mixture of divine will and patriarchal law;in terms of the connotation,Yangming’s law embodies and maintains hierarchical order;in terms of the function,Yangming emphasizes law-making and action,restraining the strong and supporting the weak;in terms of law enforcement,Yangming emphasizes justice in law enforcement.Regarding the limitations of the law,Yang Ming points out that the law should be abolished if the entrusted person is not right,and the law will be counterproductive if it is too strict.The good law requires a combination of love and law.The law of Yangming embodies the characteristics of traditional thinking,and has its advantages and limitations.
