摘  要:我国虽然采用国家学位授予制度,但高校可以制定具体的学位授予工作细则并将其作为是否授予学位决定的依据。高校制定的学位授予标准分为学术性标准和非学术性标准,学术性学位标准要符合禁止不当联结原则和比例原则,高校自主制定的非学术性学位标准要符合国家学位法律保留原则和禁止不当联结原则。法院适用禁止不当联结原则审查高校学位授予决定时,一方面要尊重高校的学术自治权,另一方面也要规制高校滥用学术自治权的行为。为避免此类案件“同案不同判”,建议最高人民法院通过指导案例对相关裁判规则予以明确阐释。Although China adopts the national degree awarding system,colleges and universities can formulate specific rules for degree awarding and use them as the basis for deciding whether to grant degrees.The degree awarding standards formulated by colleges and universities are divided into academic standards and non-academic standards.The academic degree standards independently formulated by colleges and universities should comply with the principle of prohibiting improper connection and the principle of proportionality,and the non-academic degree standards independently formulated by colleges and universities should conform to the principle of national degree law reservation and the principle of prohibiting improper connection.The court should respect the academic autonomy of colleges and universities on the one hand and regulate the abuse of academic autonomy of colleges and universities on the other hand,when applying the principle of prohibiting improper connection to review the decision of degree awarding of colleges and universities.In order to avoid“same cases,different judgments”,it is suggested that the Supreme People’s Court should clearly explain the relevant judgment rules through guiding cases.
