摘  要:为明确经济性裁员中“客观经济情况”条款的适用情况,文中通过实证研究方法对中国裁判文书网中2017—2021年劳动合同解除争议的生效判决进行统计分析。整理发现,部分法院在审理案件时对用人单位进行经济性裁员时实体是否符合以“客观经济情况发生重大变化”的情形认定存在争议,对程序合法性的审查不够,法律适用存在错误。为完善相关法律条款的适用,法院应当明确实体认定标准和程序适用、加强对实体和程序的审查,劳动行政部门应当注重审查监督,工会积极介入并加强劳动教育,加强维护劳动者合法权益。In order to clarify the application of the“objective economic situation”clause in economic layoffs,this paper conducts a statistical analysis of the effective judgments of the labor contract termination disputes from 2017 to 2021 in China Judgment Documents Network through empirical research methods.The collation found that when some courts tried the case,there was a dispute over whether the entity was in line with the situation that“there was a major change in the objective economic situation”when the employer made economic layoffs,the review of the legality of the procedure was insufficient,and there were errors in the application of the law.In order to improve the application of relevant legal provisions,the court shall clarify the application of entity identification standards and procedures,strengthen the review of entities and procedures,the labor administrative department should pay attention to examination and supervision,and the trade union should actively intervene and strengthen labor education,and strengthen the protection of the legitimate rights and interests of workers.
