摘 要:食品安全惩罚性赔偿制度的目的在于惩罚、遏制和预防食品安全领域严重违法行为,保障消费者合法权益。食品安全标准是强制性标准。“不符合食品安全标准”食品的认定应遵循整体主义的方法论,其具体包括:未经许可、登记或者备案生产经营的食品;实质性不安全的食品;食品标签不规范并可能影响实质性食品安全的预包装食品。对符合法定条件的标签内容瑕疵的预包装食品适用惩罚性赔偿制度的除外责任。The punitive compensation system in food safety aims at punishing deterring and preventing serious violations in the field of food safety,protecting the legitimate rights and interests of consumers.Food safety standards are mandatory standards.The identification of“non-compliance with food safety standards”food should follow the holistic methodology,which includes:food without produced and operated permission,registration or filing;food without substantive safety;food with nonstandard label,which may have substantial impact on food safety.The exclusions of food safety punitive damages are applicable to the pre-packaged food with the defective label that meet the legal conditions.
