摘  要:我国2020年修订的《预防未成年人犯罪法》将收容教养纳入专门教育制度,是对未成年人教育矫治的科学化。然而,专门教育制度仍存在对未成年人罪错行为分类模糊、未进行司法化改革、专门教育的期限以及条件不明确等问题。需将“严重不良行为”细分为触法行为和触警行为,明确专门教育的适用条件、适用期限,对罪错未成年进行分级管理并实现司法化改革。The revised“Prevention of Juvenile Delinquency Law”in 2020 in China includes detention and rehabilitation into a specialized education system,which is a scientific approach to the education and correction of minors.However,there are still problems with the specialized education system,such as unclear classification of juvenile delinquency,lack of judicial reform,and unclear deadlines and conditions for specialized education.It is necessary to subdivide“serious misconduct”into violations of the law and police,clarify the applicable conditions and deadlines for specialized education,classify and manage juvenile delinquents,and achieve judicial reform.
