摘 要:自中国新科技发展呈迅猛之势后,新污染物的种类骤增,有毒有害物质的治理和管理成为我国环境法领域的一大难题,美国则在此棘手问题上积累了充足经验。美国环境法确定的风险评估模型对于有毒有害物质的事前评估和事后管控均起到了重要作用。通过系统剖析美国有毒有害物质风险评估模型,并结合我国目前类似的模型基础,探知注重人才专业性培养以及提升资金投入力度对于高效处理新污染物的重要作用,我国后续在有毒有害物质的法律监管治理方面应该将提高风险评估制度衔接性作为一个主要任务。Since the rapid development of new technology in China,the types of new pollutants have increased sharply.The treatment and management of toxic and harmful substances have become a major problem in the field of environmental law in China.The United States(U.S)on the other side of the ocean has accumulated sufficient experience on this difficult issue.The risk assessment model determined by the U.S environmental law has played a great role in the pre-assessment and post-event control of toxic and hazardous substances.Through the systematic analysis of the U.S toxic and hazardous substance risk assessment model,combined with my country's current similar model basis,close attention must be paid to professional training and increased investment,which will play an important role in the efficient treatment of new pollutants.China's subsequent legal supervision and governance of toxic and hazardous substances should take improving the cohesion of the risk assessment system as a major task.
