摘 要:【目的】为促进司法实践的发展,为游戏作品提供法律保障,有必要对游戏作品法律定位进行研究。【方法】运用案例分析与比较研究的方法,对我国司法实践进行分析。【结果】在司法实践中,游戏作品法律定位因纠纷所针对游戏内容与表达形式的不同而有所不同,且在不同时期存在着不同的问题。【结论】著作权法应该区别对待游戏的内容与表达形式,内容主要包括技术实现与画面实现两个方面,表达形式包括游戏画面与游戏音乐两部分,应将游戏的具体规则的表达归入内容中,纳入保护范围。基于司法实践中的不足和对于游戏作品保护的欠缺,倡导应该将游戏作品统一归类,在著作权法上予以规定,进行保护。[Purposes]In order to promote the development of judicial practice and provide legal protection for game works,it is necessary to study the legal positioning of game works.[Methods]Case analysis and comparative study were used to analyze the judicial practice in China.[Findings]In judicial practice,with the change of disputes,the content and expression of games are different,and there are different problems in the evolution of the legal positioning of games in different periods.[Conclusions]The copyright law should treat the content and expression form of the game differently.The content mainly includes the content of technical realization and the content of picture realization.The expression form includes two parts:game picture and game music.The expression of the specific rules of the game should be included in the content and included in the scope of protection.Based on the shortcomings in judicial practice and the lack of protection of game works,it is advocated that game works should be classified uniformly and stipulated in copyright law for protection.
