摘 要:既有商法教学注重商法思维培养,囿于法律思维合规性、保守性、刚性的思维局限,难以适应商事交易实践与审判实务中对于营利性、创新性、柔性商事思维的需要。商法学研究生教育教学改革在课程设计、教学方式、师资培养等方面面临商事思维培养缺位的困境。在课程内容改革方面,应补充商法课程内容结构性缺失,阶梯化设置教学内容体系;从案例教学方式改革入手,改变满堂灌的理论教学方式,将理论学习前置于预习阶段,课堂侧重于商事案例分析能力和商事思维素养的训练提升;在师资配套改革方面,提升商法教师的商事实践素养,整合校内跨学科资源,探索双师教学模式;创新教学手段,引入商事情境模拟教学,并配合课后竞赛式实践教学环节,营造商事交易环境。While commercial law teaching emphasizes the cultivation of commercial thinking,it is limited by the compliance,conservatism,and rigidity of legal thinking,making it difficult to meet the needs of commercial transactions and judicial practices for profit-oriented,innovative,and flexible commercial thinking.The reform of business law graduate education faces challenges in curriculum design,teaching methods,and faculty training due to the lack of emphasis on commercial thinking.In terms of course content reform,it is necessary to supplement the structural deficiency of commercial law courses and establish a stepped teaching content system.Starting with case-based teaching methods,we should change the traditional theoretical teaching approach by placing theoretical learning before previewing and focusing more on the analysis of commercial cases and the training of commercial thinking skills in class.In terms of faculty development,we should enhance the practical competence of commercial law teachers,integrate interdisciplinary resources within the school,and explore the dual-teacher teaching model.Innovative teaching methods should be adopted by introducing simulated commercial scenarios into the classroom and incorporating post-class competition-based practical teaching activities to create a commercial transaction environment.
