法学视角下瑞士职业教育立法的经验与启示

摘　　要：瑞士职业教育的成就有赖于立法,从法学视角分析总结其立法经验和启示,以期为我国职业教育发展和立法研究提供有益借鉴。对瑞士职业教育主要立法的历史研究和文本比较分析发现,法律间的良性交互、分层式的职业教育立法体系、基于历史背景的分阶段立法、主动适应社会发展趋势持续修法、注重质量管理和职业导向的立法价值逻辑以及构建有效的职业教育法律运行体系,是瑞士职业教育在法律保障方面取得成功的重要经验。基于以上分析,我国职业教育立法应在职业教育法律的立改废中遵循客观规律实现科学立法,紧扣国情立法;重视职业教育的地位和作用,强化宪法保障;坚持持续修订和完善立法,并优化职业教育法律的运行保障。The achievements of Swiss vocational education depend on legislation.This study analyzes and summarizes its legislative experience and inspiration from the perspective of law science,with a view to providing useful reference for the development of China's vocational education and legislative research.Through the historical study and comparative textual analysis of the main legislation on vocational education in Switzerland,this paper finds that the important experiences of the success of Swiss vocational education in terms of legislation are as follows:benign interaction among laws,hierarchical legislative system of vocational education,phased legislation based on the unique historical background,proactive adaptation to the development trend of the society by continuous revision of the laws,focusing on the logic of the value of quality management and vocationally oriented legislation,as well as the construction of an effective law operation system of vocational education.This is the important experience of Swiss success in the laws of vocational education.Based on the above analysis,China's vocational education legislation should follow the objective laws to realize scientific legislation in the establishment,reform and abolition of vocational education laws and make laws in accordance with the national situation;pay attention to strengthen the constitutional guarantee in the status and role of vocational education;adhere to the continuous revision and improvement of the legislation and optimize the operation guarantee of vocational education laws.
