摘　　要：中华优秀传统法律文化是习近平新时代中国特色社会主义思想在动态中丰富发展的重要来源,也是马克思主义中国化的重要组成。重视中华优秀传统法律文化不仅有助于提升国家文化软实力,实现文化自信,而且有助于提升中华文化的影响力,形成同我国综合国力和国际地位相匹配的国际话语权。弘扬中华优秀传统法律文化需要同马克思主义立场观点方法结合起来,坚持辩证唯物主义和历史唯物主义,需要古为今用,对中华优秀传统法律文化进行创造性转化,也需要推陈出新,将其进行创新性发展,充实、服务于当下。中华优秀传统法律文化研究的重点不仅要讲清楚“历史渊源、发展脉络、基本走向”,而且要说明白其“独特创造、价值理念、鲜明特色”,同时还要“研究我国古代法制传统的成败得失”。The fine traditional Chinese legal culture is an important source for the enrichment and development of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era in a dynamic way,and it is also an important component of the sinicization of Marxism.Emphasis on the fine Chinese traditional legal culture does not only help enhance national cultural soft power and achieve cultural confidence,but also helps increase the influence of Chinese culture and form an international power of discourse that matches China's comprehensive national power and international status.To enhance the fine Chinese traditional legal culture,it is necessary to combine it with the position and viewpoint of Marxism,adhere to dialectical materialism and historical materialism,and to creatively transform the fine Chinese traditional legal culture,as well as to innovatively develop it,so as to serve the present.The focus of the study of the fine Chinese traditional legal culture is not only to clarify the"historical origin,development and basic direction",but also to understand its"unique creation,value concept and distinctive features",and at the same time to"study the successes and failures of Chinese ancient legal tradition".
