摘 要:储备教师作为一种新的教师身份,有别于其他代课教师,具有特殊性。相应的法律与制度机制建设不完善,导致其产生关于编制获得、享有薪酬待遇等权利保护的困境。为此,本研究针对因人事考核未及时入编或被辞退、因学校申报或区政府给付问题产生薪酬拖欠等权利救济路径进行探析。As a new teacher identity,reserve teacher is different from other substitute teachers and has its particularity.The construction of the corresponding legal and institutional mechanisms is not perfect,which leads to the dilemma of the protection of the rights to obtain and enjoy remuneration.To this end,the author puts forward the analysis of the right remedy path for the failure of recruitment or dismissal due to personnel assessment,and the arrears of salary due to the problems of school declaration or district government payment.
