摘  要:在“双减”政策背景下,国家已经开始推进校外培训监管立法,对相关立法设计展开研究极具必要性。当前校外培训机构发展欠缺法律规范,校外培训监管依据不足,学生合法权益保障不足,这充分体现出相关立法活动的紧迫性。校外培训监管立法须明确规范校外培训活动和促进未成年人健康成长之立法目的;确立党的领导、未成年人权益保障、公益性和分类监管的基本原则。在校外培训监管立法目的和立法原则的指引下,构建准入许可、收费监管、从业监管、安全管理和法律责任等法律制度体系,是推进校外培训行业高质量发展的重要保障。Under the background of the“Double Reduction Policy”,the state has begun to promote the legislation on the regulation of off-campus training,making it extremely necessary to research the relevant legislation design.Currently,the development of extracurricular training institutions lacks legal norms;the regulatory basis for extracurricular training is insufficient;and the protection of the legitimate rights and interests of students is inadequate.This fully reflects the urgency of launching relevant legislative activities.The legislation on the regulation of off-campus training must clarify its legislative purposes for standardizing extracurricular training activities and promoting healthy growth of minors.It should establish basic principles such as the leadership of the party,the protection of the rights and interests of minors,public welfare,and categorized supervision.Under the guidance of the objectives and principles of the legislation,the construction of a legal system including admission permits,fee regulation,practitioner regulation,safety management,and legal liability is an important guarantee for the high-quality development of the off-campus training industry.
