摘　　要：以房养老社会共生关系是一种资源互换型的共生关系,由主体要素、资源要素和约束条件三部分构成。城市老龄人口作为一方主体与另一方主体农民工及城市无房低保人员,以住房资源与意定监护关系资源在平等自愿的基础上进行资源互换。相对独立的住房资源可通过居住权设立的方式取得,居住权益可扩展至同居住权人存在人身关系或人身依附关系的家庭成员。意定监护关系资源的供给方为个人,稳定性相对较差,可将与居住权人共同居住的成年家属列为第二顺位的意定监护人。为维持和促进资源互换型共生关系的良性运行,应坚持意定监护过程中“人财分离”的原则,并借助监护监督之力,在共生主体之间寻求平衡。The symbiotic relationship between housing and elderly care is a kind of resource exchange symbiotic relationship,which consists of three parts:subject elements,resource elements and constraints.The urban elderly population,as one entity,exchanges resources with other entities,such as migrant workers and urban subsistence allowance recipients,on an equal and voluntary basis through housing resources and intended guardianship resources.Relatively independent housing resources can be obtained through the establishment of residency rights,and residency rights can be extended to family members who have personal relationships or attachment relationships with the person who has residency rights.The provider of the intended guardianship resources is an individual with relatively poor stability,and adult family members who live together with the person who has residency rights can be listed as the second ranked intended guardians.To maintain and promote the healthy operation of the resource-exchange symbiotic relationship,the principle of"separation of man and property"should be adhered to in the process of intended guardianship,and a balance should be sought between symbiotic entities through the power of guardianship supervision.
