地方高校模拟法庭比赛的问题检视与完善建议——以学生实践创新能力的培养为视角

摘　　要：地方高校模拟法庭比赛的规则和运行机制等仍存在提升空间。未来模拟法庭比赛应进一步优化程序规则。模拟案例素材的甄选应当密切关注前沿性的争议案件,并合理改编案例以增加模拟案例的对抗性和复杂性。对参赛队员的遴选应当综合考量其各方面能力。参赛队伍可以尝试与司法实务部门对接和切磋,不断提升学生参加庭审的实战能力。模拟赛事应积极吸引商事仲裁员与检察官作为赛事评委。为提升评议效果,评委应统一评审尺度,全面、客观和中肯地点评比赛各方的庭审表现。受模拟法庭比赛启发,理论教学应当不断推进鉴定式和案例式教学改革。为提升学生的实践创新能力,可以尝试构建并推行法学专业现代师徒制的实践教学模式。There is still room for improvement in the rules and operation mechanism of the moot court competition in local universities.Procedure rules should be further optimized in future moot court competitions.The selection of the simulated case materials should pay close attention to the leading controversial cases,and the cases should be reasonably adapted to increase the antagonism and complexity of the simulated cases.The selection of the players should take into account all aspects of their abilities.The participating teams can try to connect and learn with the judicial practice departments to constantly improve the students’practical ability to participate in the trial.The simulation competition should actively attract commercial arbitrators and prosecutors to be the judges.In order to improve the evaluation effect,the judges should unify the evaluation scale,and comment comprehensively,objectively and pertinently on the trial performance of all parties in the competition.Inspired by the moot court competition,theoretical teaching should continuously promote the reform of appraisal and case teaching.In order to improve students’practical innovation ability,we can try to construct and implement the modern practical teaching mode of law major.
