摘　　要：习近平法治思想蕴涵着丰富的刑事司法公正论断。基于“公正是司法的生命线”这一基本理念,以“让人民群众在每一个司法案件中都能感受到公平正义”为崇高目标,以建设“高素质司法队伍”和完善的司法体制作为必要条件和基本保障,从系统观念出发来推进司法公正的实现,这一系列新理念新论述,是新时代刑事司法公正观最重要的思想源泉。新时代刑事司法公正观是司法主体公正、程序公正和实体公正有机融合的司法公正观,具有“整体性”“全面性”和“辩证性”的理论特质。新时代刑事司法公正观以刑事司法形式新发展、刑事司法信息技术新突破和公众参与刑事司法新样态为实践基础,显示出强大的生命力,能够引领未来刑事司法不断向前发展,建构中国自主的刑事司法知识体系。Xi Jinping’s Thought on the Rule of Law contains rich judgments on criminal judicature.The series of new ideas and new discussions,such as“justice is the lifeline of judicature”,“making the people feel fairness and justice in every judicial case”,constructing a“high-quality judicial team”and a sound judicial system as necessary conditions and basic guarantees,and starting from the system concept to promote the realization of judicial justice,is the most important ideological source of criminal judicature justice concept in the new era.The concept of criminal judicial justice in the new era is an organic integration of judicial subject justice,procedural justice and substantive justice,which has the theoretical characteristics of“integrity”,“comprehensiveness”,and“dialectics”.Based on the new development of criminal justice forms,the new breakthrough of criminal justice information technology and new pattern of public participation in criminal justice,the new concept of criminal judicial justice shows strong vitality,which can lead the continuous development of criminal judicature in the future and construct China’s independent criminal judicial knowledge system.
