摘　　要：儒家之礼概括和总结了自三代以来社会规范体系中的内部逻辑证成。礼在法律规则和社会关系中的外化表现为礼制,内化形态为礼义。礼制是律己、敬人、慎行的最基本要求和最直接表现;礼义是个体生活的理想信念,同时也是家国治理的基本纲领,是蕴含于各项制度中的精神原则,二者由表及里共同发挥着作用。作为中国古代社会法律体系的源泉和基石,礼上承天道,下资治世,是世俗法律的正当性来源。礼为社会秩序的创设与维护提供基本范式和隐性指引,自身在时代变迁中既能与时俱进,又能坚守恒久价值。作为个体的立身之本,礼陶冶人文情怀,是教化民众的政治培基。礼从天道、秩序、教化三个方面发挥着根本性作用,构建起古代社会的礼法系统,成为律法的渊源和纲领,从而将天道规律转化为世间的具体规则,并推动天道与治世二者的精妙结合。The Confucian Rites summarize the internal logical evidence in the social norm system before 771.BC.The externalization of propriety in legal rules and social relations is manifested in etiquette,while the internalization is manifested in the form of righteousness.Ritual system is the most basic requirement and direct manifestation of self-discipline,respect for others,and prudence in behavior;Righteousness are the ideals and beliefs of individual life,as well as the basic program of national governance.They are spiritual principles embedded in various systems,and both play a role together from the outside to the inside.Confucian Rites is the source and cornerstone of the ancient Chinese social legal system.The rite inherits the natural law and becomes the source of legitimacy of the secular law.Confucian Rites provides a basic paradigm for the creation of social order,and becomes the bond for maintaining social order.Confucian Rites provides basic paradigms and implicit guidance for the creation and maintenance of social order.They can not only keep up with the times,but also adhere to long-term values in the changing times.As the foundation of individual standing,Confucian Rites cultivates humanistic sentiments and serves as the political foundation for educating the people.Confucian Rites play a fundamental role in the three aspects of the natural law,order,and education,constructing the system of etiquette and law in ancient society,becoming the source and guiding principle of law,thereby transforming the laws of the natural law into specific rules in the world,and promoting the exquisite combination of the natural law and governance.
