摘 要:《法哲学原理序言》中包含了大量时代论战意图和哲学隐喻。对其解释需要充分考虑此书的教科书性质和体系性作用,结合时代论战要点与体系发展历程加以合理补充,而不能限于“序言”的外在和主观的简略表达。我们所提供的一种新解读,将序言理解为对“天真心灵”所追求的幸福的法效力,以及对主观法所坚持的个体良知的法承认的批判。在此基础上,还有一种对基于个体的自由和共同的反思性协调的新自然法可能性的提示。这两个部分分别对应着序言中的两个关键隐喻:“哲人石”与“蔷薇”,它们共同将人引入对现实与理性关系的系统哲学思考,指明了理性辩护与交互承认对去除幻相、建立共同体法基础的关键意义。The“Preface”to Philosophy of Right contains a large number of polemical intentions of the times and philosophical metaphors.Its interpretation needs to take full account of the textbook-related nature and systemic role of the book,and add reasonably to it in the light of the polemical points of the times and the development of the system,rather than limiting itself to the external and subjective brief expression of the“Preface”.This paper offers a new interpretation of the“Preface”as a legal validity of the happiness sought by the“ingenuous mind”and a critique of the legal recognition of individual conscience upheld by the subjective law.On this basis,there is also a hint of possibility of a new natural law based on individual freedom and a common reflective harmonization.These two parts correspond to the two key metaphors in the“Preface”:“the Philosopher s Stone”and“the Rose”,which together introduce people to a systematic philosophical reflection on the relationship between reality and reason,and point to the crucial significance of the defence of reason and the reciprocal recognition for the removal of illusions and the establishment of the basis of the Law of Communion.
